An introduction to applying the Mental Capacity Act (MCA) 2005 in education, exploring the issues for educational psychologists 28 June 2017 This workshop is focussed on specifically applying the MCA in relation to educational decisions. It introduces the MCA principles, including concepts and language, as well as definitions of capacity and to lack capacity, and determining when and how to undertake capacity assessments. An EP’s role in relation in assessing a young person’s capacity, for example when requested to do so on behalf of another education professional, and other professional and ethical issues will be explored. There will be a focus on good practice for undertaking capacity assessments and an EP’s reflection on the process, for example using the BPS and SCIE (2010) Audit tool for Mental Capacity Assessments, as well as working with the young person’s parents in relation to the young person’s capacity to make their own decisions. Discussions will be facilitated using case studies.
